A federal appeals court has dismissed the lawsuit by Planned Parenthood of the Heart of the United States that accused the group of failing to provide health care for patients at the state and national clinics and failing to take care of a patient whose life was at risk.
The decision by US District Court Judge Nita Kaplan and the U.S. Court of Appeals for the Tenth Circuit upheld a lower court ruling earlier this month that the group did adequate counseling services at some of the clinics it operated, according to a news release from Kaplan.
The 10-page opinion that followed Tuesday’s vote upheld a lower court ruling in the case, also involving the National Organization for Women, that said Planned Parenthood of the Heart of the U.S. failed to provide health care for patients at the clinics.
The agency said it had provided health care to a woman named Abigail Gertrude.
Gertrude is an abortion provider who says she was the primary caregiver of her unborn baby under the law.
In March 2013, the U.S. Health and Human Services Department said Gertrude had been denied state Medicaid coverage because she was a contaminated employeeemployee at Planned Parenthood. Gertrude said that health care was not available in her state because of restrictions that went into effect in 2010.
Kraken, the panelist for the lower court, said it is disappointed by the outcome and would appeal.
The Court of Appeals is not satisfied with the Government’s reasoning when addressing a ‘contaminated workeremployee,’ the ruling said.
